Account Registration & Responsibility
To access certain features on Excelerate, you will need to register for an account. By creating an account, you agree to the following requirements:
A. Eligibility
You must be at least 18 years old to create and operate an account on the Platform. Individuals between the ages of 15 and 17 may only access the Platform through an account registered and controlled by a parent or legal guardian, with appropriate permission and supervision. Individuals under the age of 15 are not permitted to use the Platform or its services. Account holders are fully responsible for any activity carried out by a minor on their account.
B. Information Accuracy
You agree to provide complete, accurate, and current information when registering for and maintaining your account. You may not provide false information, misrepresent your identity, or impersonate any individual, organization, or entity.
C. Appropriate Account and Profile Name
If you choose not to use your real name as your account name, ensure that your chosen name does not contain offensive, vulgar, or inappropriate language, and does not infringe upon the intellectual property rights of any third party.
D. Account Responsibility
You are solely responsible for all activity that takes place on your account. Where an account is shared, the individual whose financial information is associated with the account bears ultimate responsibility for all transactions and activity. If you are registering on behalf of a business, you confirm that you have the legal authority to accept these Terms on the business's behalf. Accounts may not be transferred to another party without prior written consent from Excelerate.
E. Account Security
You are responsible for maintaining the confidentiality and security of your login credentials, including your password. You agree to take reasonable measures to prevent unauthorized access to your account and to notify us promptly of any suspected unauthorized use, security breach, or compromise of your account.
A. Ownership of Content
Creators retain ownership of all content they upload, publish, or otherwise make available through the Platform, including but not limited to courses, videos, documents, images, descriptions, usernames, profile information, comments, and other materials ("Content").
The Platform does not claim ownership of Creator Content. However, by publishing Content, creators grant the Platform the rights necessary to host, operate, distribute, and promote such Content as described below.
B. Your Responsibility
You are solely responsible for everything you post on Excelerate. By uploading content, you confirm that:

By publishing Content on Excelarete, creators grant the Platform a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, adapt, modify, translate, display, distribute, and otherwise use the Content solely for the purpose of operating, improving, securing, marketing, and promoting the Platform and its services.

This license remains in effect for as long as the Content is hosted on the Platform and for a reasonable period thereafter as necessary for operational, legal, archival, backup, or promotional purposes.
A. Content Standards
All content published on Excelerate must be accurate, honest, and lawful. You agree not to post any content that is abusive, threatening, defamatory, obscene, vulgar, fraudulent, or otherwise offensive or misleading. Content that violates any part of these Terms, or that is designed to deceive or defraud other users, is strictly prohibited.

C. AI-Generated Content
Excelerate permits the use of AI tools in the creation of templates and tutorials, subject to the following conditions:
Creators are responsible for ensuring that all content they publish is lawful and does not infringe the rights of any third party. Repeated intellectual property violations may result in the suspension or permanent termination of an account.
Creators remain solely responsible for the accuracy, legality, safety, and integrity of all content they publish.
A. Our Right to Moderate Content
Excelerate reserves the right to review, investigate, remove, restrict, demonetise, or disable access to any content that we reasonably believe violates these Terms, applicable laws, third-party intellectual property rights, or our platform policies. This applies at our sole discretion and may occur without prior notice.
During any active investigation, content may be temporarily restricted or disabled while the matter is being reviewed. You agree that Excelerate bears no liability for any such action taken in good faith to protect the platform, its users, or rights holders.
B. User Reporting
Any user may report content they believe violates these Terms using the reporting tools available on the platform. All reports are reviewed by our team within a reasonable timeframe, although response times may vary depending on the nature and complexity of the matter. Excelerate will determine the appropriate course of action, which may include:

If your content has been removed or your account has been restricted, you have the right to appeal the decision by contacting us at support@excelerate.com. We will review all valid appeals and respond within a reasonable timeframe. Excelerate's decision following an appeal is final.
D. Reporting Unauthorised Content
Excelerate is committed to protecting intellectual property rights. If you believe your content has been published on our platform without your authorisation, you may submit a formal takedown request by contacting us at support@excelerate.com. Upon receipt of a valid request, we will investigate promptly and take appropriate action, which may include temporarily account restriction, disabling, demonetisation, or removal of content where we reasonably believe it may violate these Terms, applicable laws, intellectual property rights, or Platform policies.
If your own content is reported as infringing upon another party's intellectual property rights, we will notify you and take action in accordance with our policies.
E. Account Enforcement
Accounts found to be in repeated or serious violation of these Terms may be subject to one or more of the following:
Excelerate reserves the right to preserve relevant records and cooperate fully with law enforcement and legal authorities where required by law or where necessary to protect the rights and safety of our users, rights holders, and the platform.
Repeat copyright infringement will result in permanent account termination without exception.
A. Your Indemnification Obligations
If Excelerate receives any claim, lawsuit, demand, inquiry, or legal action arising from your actions, your use or misuse of the platform, your breach of these Terms, or your violation of any applicable law or third-party rights, you agree to fully defend, indemnify, and hold harmless Excelerate and its employees, officers, directors, agents, subsidiaries, and affiliates from any resulting losses, damages, liabilities, and legal costs, including reasonable attorney fees.
This applies equally to creators — by publishing content on Excelerate, you agree to indemnify the platform against any claims, damages, or expenses arising from your uploaded content or any violation of these Terms.
Excelerate reserves the right to manage its own legal defence as it sees fit. Where you are obligated to indemnify us, you agree to cooperate fully with our legal strategy.
B. Marketplace Disclaimer
Excelerate is a marketplace platform — we do not create, produce, or independently verify the content, templates, or tutorials sold by creators on the platform. Accordingly, Excelerate makes no warranties regarding the quality, accuracy, safety, authenticity, or legality of any item listed or sold through our Services.
Any dispute or legal claim relating to a purchase must be directed to the creator or seller of the content in question. By using our platform, you release Excelerate from any claims arising from purchases made through our Services, including claims related to defective, inaccurate, or misrepresented content.
C. Interactions Between Users
Excelerate may facilitate connections between users and while we may implement moderation, reporting, verification, or safety measures, we do not guarantee the conduct, identity, accuracy, or reliability of any user beyond what is required to meet our legal and compliance obligations. You acknowledge that any interaction you have with other users — whether online or in person — is at your own risk. Excelerate accepts no liability for any disputes, damages, or harm arising from such interactions. We encourage all users to exercise caution and good judgement when engaging with others through the platform.
D. Third-Party Services
The Platform may contain links to, integrations with, or dependencies on third-party websites, applications, products, services, payment processors, advertising networks, or other external resources.
Your use of such third-party services is governed solely by the terms, conditions, and privacy policies of the relevant third party. Excelarete does not own, control, endorse, or assume responsibility for any third-party service and shall not be liable for any loss, damage, claim, or dispute arising from your use of or reliance on such services. We encourage you to review the terms and privacy policies of any third-party service you use in connection with Excelarete.
E. Promotions and Offers
From time to time, Excelarete may offer promotions, discounts, incentives, credits, or other special offers. Eligibility, availability, duration, and redemption of such offers are determined solely by Excelarete and may be modified, suspended, or withdrawn at any time without notice.
Excelarete is not responsible for promotions, offers, discounts, or incentives provided independently by creators, sellers, or third parties, and any disputes relating to such offers must be resolved directly with the party providing them.
We reserve the right to modify, update, replace, or remove any part of these Terms at any time to reflect changes to our Platform, Services, business operations, legal requirements, or policies.
Where required by law or where changes are material, we will provide reasonable notice by posting an update on the Platform, sending an email, or using other appropriate communication methods. The updated Terms will become effective on the date specified in the notice.
Your continued use of Excelerate following the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree with the revised Terms, you are free to close your account at any time.
We encourage you to review these Terms periodically to stay informed of any updates.
These Terms and any disputes arising from or related to your use of Excelerate — including disputes relating to their validity, interpretation, enforcement, or termination — shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any legal disputes that cannot be resolved amicably between the parties shall be submitted to the exclusive jurisdiction of the competent courts in Leipzig or Berlin, Germany. By using our platform, you irrevocably agree to the jurisdiction of these courts and waive any objection to proceedings being brought in these locations.
